26 Countries Face EU Action on Energy Laws

The European Commission has launched infringement procedures against 26 EU member states for failing to transpose the provisions of the revised Renewable Energy Directive (RED) into national law. Only Denmark met the July 2024 deadline to implement these provisions, which aim to simplify and expedite permitting procedures for renewable energy projects.

 

The revised RED came into force in November 2023, requiring EU nations to introduce streamlined processes for permitting renewable energy infrastructure, including clear time limits for approvals and a single contact point for applications. The directive also presumes that renewable energy projects serve the public interest, further incentivizing their development.

The Commission has sent formal notices to 26 countries, giving them a two-month deadline to respond and fully transpose the provisions. If the responses are deemed unsatisfactory, the Commission may issue a reasoned opinion, a precursor to further legal action.
